    1. Introduction

    These Terms and Conditions ("Terms", "Terms and Conditions") govern your relationship with the BetterPave website and services operated by BetterPave ("us", "we", or "our"). Please read these Terms and Conditions carefully before using our website and services.

    Your access to and use of the service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use our services.

    By accessing or using the service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the service.

    2. Services

    BetterPave provides paving solutions for residential, commercial, and industrial properties across Gauteng. Our services include, but are not limited to, driveway paving, walkway installation, patio creation, parking lot paving, and industrial flooring solutions.

    Any quotes provided by BetterPave are valid for 30 days from the date of issue, unless otherwise stated. The quoted price may be subject to change if the scope of work changes or if there are unforeseen circumstances that affect the cost of materials or labor.

    3. Payment

    Payment terms will be specified in the project agreement. Typically, we require a deposit before work begins, with the balance due upon completion of the project. All payments should be made according to the payment schedule outlined in your contract.

    Payment methods accepted include electronic funds transfer (EFT), credit card payments, and cash. Checks are not accepted unless specifically arranged in advance.

    4. Schedule and Delays

    BetterPave will make every effort to complete the project within the estimated timeframe. However, delays may occur due to weather conditions, material availability, or other factors beyond our control. We will communicate any anticipated delays as soon as possible.

    In the event of a delay caused by the client (such as changes to the project scope or lack of site access), additional charges may apply.

    5. Warranties and Guarantees

    BetterPave provides a workmanship warranty for all paving projects. The specific terms and duration of the warranty will be outlined in your contract. This warranty covers defects in workmanship but does not cover damage caused by improper use, normal wear and tear, or acts of nature.

    Material warranties are provided by the manufacturers of the products used and vary by product. We will provide you with all relevant warranty information upon project completion.

    6. Property Access and Site Conditions

    The client must provide clear access to the work site during the scheduled work hours. Any obstacles that could impede the work should be removed before the project start date.

    The client is responsible for identifying and marking any underground utilities, irrigation systems, or other features that might be affected by the paving work. BetterPave is not responsible for damage to unmarked utilities or features.

    7. Cancellation and Termination

    If the client wishes to cancel a project after signing the contract, a cancellation fee may apply. The fee amount will depend on the stage of the project and costs already incurred by BetterPave.

    BetterPave reserves the right to terminate a contract if the client breaches these Terms and Conditions or if unforeseen circumstances make it impossible to complete the project as agreed.

    8. Intellectual Property

    All content on the BetterPave website, including but not limited to text, graphics, logos, images, and software, is the property of BetterPave or its content suppliers and is protected by South African and international copyright laws.

    The compilation of all content on this site is the exclusive property of BetterPave and is protected by South African and international copyright laws.

    9. Limitation of Liability

    To the maximum extent permitted by applicable law, BetterPave and its suppliers shall not be liable for any indirect, incidental, special, consequential, or exemplary damages resulting from your use or inability to use the service or for the cost of procurement of substitute services.

    In no event will BetterPave's total liability to you for all damages, losses, and causes of action exceed the amount paid by you to BetterPave, if any, for accessing or using our services.

    10. Governing Law

    These Terms shall be governed and construed in accordance with the laws of South Africa, without regard to its conflict of law provisions.

    Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

    11. Changes to These Terms

    We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

    By continuing to access or use our service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the service.
